Who processes your data?

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“General Data Protection Regulation”), the controller of the personal data you provide is models4media s.r.o, ID No.: 07630093, with registered office at Koperníkova 2281/2, Vinohrady, 120 00 Prague 2 (hereinafter referred to as the “Controller”), to whom you can contact in case of questions or discrepancies with the processing of personal data.

We only process personal data that you provide to us in connection with the use of our modeling agency services.

How long do we process your data?

We will process your data for as long as the contract is concluded with you or for the duration of your consent, unless your consent to the processing of personal data is withdrawn.
However, we would like to point out that we must process the personal data that are necessary for the proper provision of the service or for the fulfilment of all our obligations, whether these obligations arise from generally binding legal regulations, regardless of the consent you have given, for the period of time specified by the relevant legislation or in accordance with it, even after your consent has been withdrawn.

Can we process your personal data without your consent?

Yes, we may process your personal data without your consent, but only for the purpose of providing a service or fulfilling legal obligations arising for us from generally binding legal regulations or processing that is necessary for the purposes of our legitimate interests.
The possibility and lawfulness of such processing follows directly from the applicable legislation and your consent to such processing is not required.

On what basis can we process your personal data?

As mentioned above, we may process your personal data on the basis of your consent, but also, for example, on the basis of our legitimate interest, to the extent that the personal data is necessary for such fulfilment. Last but not least, the reason that allows us to process your personal data without your consent is to fulfil our obligations under the law. For which specific purposes we carry out the individual processing of your personal data we list above.

How is my personal data secured?

Any personal information you provide to us is secured by standard procedures and technologies. However, it is not objectively possible to fully guarantee the security of your personal data. Therefore, it is also not possible to 100% ensure that the personal data you provide cannot be accessed, copied, disclosed, altered or destroyed by a third party by breaching our security measures.
However, we assure you that we regularly check the system for vulnerabilities and exposure to attack and use security measures that, as far as possible, prevent unauthorised access to your personal data and that provide sufficient security in view of the current state of technology. The security measures taken are then regularly updated.

How and when can you withdraw your consent to the processing of personal data?

You can withdraw your voluntary consent to the processing of personal data at any time free of charge. Withdrawal of consent does not affect the possibility to continue processing your personal data on the basis of your consent given prior to withdrawal. Withdrawal of consent also does not affect the processing of personal data that we process on a legal basis other than consent.

 

Am I obliged to provide my personal data? What if I do not provide personal data?

You voluntarily provide us with your personal data in order to use our services. If you do not provide personal information to the extent necessary to provide our services, you will not be able to fully use our services.

What rights do you have in relation to data protection?

In particular, you have the following rights in relation to your personal data:

the right to withdraw your consent at any time;
the right to rectify or complete personal data;
the right to request restriction of processing;
the right to object to or complain about processing in certain cases;

What does it mean that you have the right to object?

 

If you would no longer like to receive a commercial communication or other information about news from us from time to time, you can object to the further processing of your personal data for direct marketing purposes. If you do so, we will no longer process your data for this purpose and will not send you further commercial communications and newsletters.

RIGHT TO ACCESS YOUR PERSONAL DATA

As a data subject, you have the right to request that we tell you whether we process your personal data.
If we are processing your personal data, you have the right to access this personal data. You may also request certain other information regarding the processing of your personal data, such as the purposes of the processing, the categories of personal data concerned or the intended period of time for which the personal data will be stored and, if this cannot be determined, at least the criteria used to determine it.

Right to WITHDRAW CONSENT TO THE PROCESSING OF PERSONAL DATA

If the processing of your personal data is based on your voluntary consent, you have the right to withdraw your consent at any time.
Withdrawal of consent does not affect the lawfulness of processing based on consent given before its withdrawal, nor the lawfulness of processing based on a legal ground other than your voluntary consent.

Right to rectification

One of the fundamental principles of the processing of personal data is its accuracy. If you believe that the personal data we process about you is inaccurate, you may request its rectification. We will verify the personal data in question at your request and correct any inaccuracy.
Taking into account the purpose of the processing, you may also request the completion of incomplete personal data.

Right to erasure

If one of the grounds set out in the GDPR applies and at the same time the processing of your personal data is not necessary in view of any of the circumstances which exclude the exercise of this right under the GDPR, you have the right to request that we erase (destroy) your personal data and no longer retain it.
The grounds for which you may request the erasure of your personal data include, but are not limited to, the fact that your personal data is no longer necessary for the purposes for which it was collected or otherwise processed, that you have withdrawn your consent to the processing of your personal data and there is no other legal basis for processing it (see also “right to withdraw consent to the processing of personal data”), or if your personal data has been processed unlawfully.

Should the processing of your data be restricted, your personal data, with the exception of storage, may only be processed with your consent or for the establishment, exercise or defence of legal claims, for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or one of its Member States

However, the right to data portability must not adversely affect the rights and freedoms of other persons.


Right to object

You have the right to object, on grounds relating to your particular situation, to the processing of your personal data where the processing is carried out for reasons of public interest, in the exercise of official authority or for the purposes of the legitimate interests of the controller or third party concerned. If you raise such an objection, your data will continue to be processed only if there are demonstrable compelling legitimate grounds for processing which override your interests or rights and freedoms or for the establishment, exercise or defence of legal claims.
Where your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, which includes profiling where it relates to such direct marketing.

Right not to be subject to automated individual decision-making, including profiling

As a data subject, you have the right not to be subject to any decision based solely on automated processing, including profiling, which has legal effects concerning you or similarly significantly affects you.
This does not apply if the decision is necessary for entering into or performance of a contract between you and the controller, or if it is based on your explicit consent, or if it is permitted by generally binding legal provisions.

Right to lodge a complaint with a supervisory authority


Without prejudice to any other administrative or judicial remedies, you have the right to lodge a complaint with a supervisory authority, in particular in the country of your habitual residence, place of employment or place of the alleged infringement, if you consider that the processing of your personal data infringes the GDPR.
In the Czech Republic, this supervisory authority is the Office for Personal Data Protection, www.uoo.cz.
You will be informed of the progress and outcome of the complaint by the supervisory authority with which you lodge the complaint.

Notification of personal data breaches

The protection of your personal data is also ensured by the obligation of any data controller to notify you without undue delay of a personal data breach where a breach is likely to result in a high risk to your rights and freedoms. This notification obligation is not required when specified safeguards are in place or would require disproportionate effort to comply with.

Jaké Vaše osobní údaje zpracováváme?

Zpracováváme pouze osobní údaje, které nám poskytujete v souvislosti s využíváním našich služeb modelingové agentury.

Co jsou cookies a jaké druhy cookies používáme?

Cookies jsou malé datové soubory, díky kterým si navštívené webové stránky pamatují úkony a nastavení jednotlivých uživatelů, které na nich provedli, takže se tyto údaje nemusí zadávat opakovaně. Soubory cookies se ukládají do jednotlivých počítačů pomocí webového prohlížeče. Jak dlouho Vaše údaje zpracováváme?

Ano, Vaše osobní údaje můžeme zpracovávat i bez Vašeho souhlasu, ale pouze za účelem poskytnutí služby či splnění právních povinností, které pro nás vyplývají z obecně závazných právních předpisů či zpracování, jež je nezbytné pro účely našich oprávněných zájmů.
Možnost a zákonnost takového zpracování vyplývá přímo z platných právních předpisů a Váš souhlas k tomuto zpracování není potřeba.

Na základě čeho můžeme zpracovávat Vaše osobní údaje?

Jak už bylo řečeno, Vaše osobní údaje můžeme zpracovávat jednak na základě Vámi uděleného souhlasu, ale dále například také na základě našeho oprávněného zájmu, a to v rozsahu osobních údajů, které jsou k takovému splnění nezbytné. V neposlední řadě je pak důvodem umožňujícím nám zpracovávat Vaše osobní údaje i bez Vašeho souhlas plnění povinností vyplývající pro nás ze zákona. Pro jaké konkrétní účely provádíme jednotlivá zpracování Vašich osobních údajů uvádíme výše.

Jak jsou mé osobní údaje zabezpečeny?

Veškeré osobní údaje, které nám poskytnete, jsou zabezpečeny standardními postupy a technologiemi. Není však objektivně možné zcela zaručit bezpečnost Vašich osobních údajů. Proto není ani možné 100 % zajistit, že k poskytnutým osobním údajům nemůže třetí osoba získat přístup, nemohou být zkopírovány, zveřejněny, pozměněny nebo zničeny prolomením našich bezpečnostních opatření.

Jak a kdy můžete svůj souhlas se zpracováním osobních údajů odvolat?

Váš dobrovolně udělený souhlas se zpracováním osobních údajů můžete kdykoli bezplatně odvolat. Odvoláním souhlasu není dotčena možnost i nadále zpracovávat Vaše osobní údaje na základě Vašeho souhlasu, který byl dán před jeho odvoláním. Odvolání souhlasu také nemá vliv na zpracování osobních údajů, které zpracováváme na jiném právním základu, než je souhlas.

Jsem povinen poskytnout své osobní údaje? Co když osobní údaje neposkytnu?

Vaše osobní údaje nám poskytujete dobrovolně za účelem využívání našich služeb. V případě, že neposkytnete osobní údaje v nezbytně nutném rozsahu k poskytování našich služeb, tak Vám nebude umožněno našich služeb plně využívat.

Jaká všechna práva máte v souvislosti s ochranou osobních údajů?

Ve vztahu k Vašim osobním údajům máte zejména následující práva:

  • právo svůj souhlas kdykoli odvolat;
  • právo osobní údaje opravit či doplnit;
  • právo požadovat omezení zpracování;
  • právo vznést námitku či stížnost proti zpracování v určitých případech;
  • právo požadovat přenesení údajů;

Co to znamená, že máte právo vznést námitku?

Pokud by se Vám již nelíbilo, že od nás čas od času dostanete nějaké obchodní sdělení či jinou informaci o novinkách, máte možnost vznést námitku proti dalšímu zpracovávání Vašich osobních údajů za účelem přímého marketingu.
